Appellate Division Affirms Summary Judgment in Malicious Use of Process suit against Fair Lawn

On March 20, 2016, the Appellate Division affirmed the trial court's decision granting Summary Judgment to the Borough of Fair Lawn in a suit filed by a resident business owner against the Borough's Fire Marshall. In a unanimous decision, the Court found that the trial court properly found that a failure to prove special damages was fatal to Plaintiff's claim.
